THIS TIGER DAM FLOOD PROTECTION KIT IS SOLD ‘AS IS’ WITH NO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY LAW. TIGER DAM WARRANTS THE PRODUCT AGAINST DEFECTS IN MATERIALS AND WORKMANSHIP UNDER NORMAL USE FOR ONE (1) YEAR FROM THE DATE OF PURCHASE. IF A DEFECT ARISES, TIGER DAM™ WILL, AT ITS OPTION, REPAIR, REPLACE, OR REFUND THE PURCHASE PRICE ($379). THIS WARRANTY DOES NOT COVER DAMAGE FROM IMPROPER INSTALLATION, MISUSE, EXTERNAL CAUSES (E.G., EXTREME WEATHER BEYOND THE PRODUCT’S CAPACITY), OR MODIFICATIONS.

LIMITATION OF LIABILITY
TO THE EXTENT PERMITTED BY LAW, TIGER DAM IS NOT LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING PROPERTY DAMAGE FROM FLOODING, LOSS OF USE, OR OTHER LOSSES, WHETHER FROM BREACH OF WARRANTY OR OTHER LEGAL THEORY. TIGER DAM’S TOTAL LIABILITY IS LIMITED TO THE PURCHASE PRICE ($379). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR EXCLUSION OF CONSEQUENTIAL DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

By purchasing this product, you agree to indemnify, defend, and hold harmless Tiger Dam, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, damages, liabilities, or expenses (including reasonable attorney’s fees) arising from your misuse, improper installation, negligent use, or failure to follow provided instructions for the Tiger Dam Flood Protection Kit. This includes, but is not limited to, third-party claims (e.g., property damage to neighboring properties caused by improper use of the product).

CLAIMS PROCESS
To make a claim, contact Kirsten@usfloodcontrol.com within 30 days of discovering a defect, with proof of purchase. Return instructions will be provided. TIGER DAM is not responsible for shipping costs or damage during return.

Carefully examine your property’s layout and the natural flow of water during heavy rain or flooding. Identify where water currently drains and where it might be diverted. Avoid directing water onto neighboring properties, public land, or areas where it could cause erosion or flooding. Consult local ordinances and environmental regulations related to water diversion, drainage, or flood control. If you live in a community with a Homeowners Association (HOA), review the HOA’s rules and covenants regarding landscaping and water management. Watch for signs of water pooling, erosion, or damage to neighboring properties. Make adjustments as needed to ensure water is safely redirected.
